📄 Terms and Conditions – Soundiary
These Terms and Conditions ("Terms") govern your access to and use of Soundiary, a software-as-a-service (SaaS) product provided by Muso Play On PTY LTD ("we", "us", "our"), an Australian company registered in Victoria. By accessing or using Soundiary, you agree to comply with and be bound by these Terms. If you do not agree, please do not use the platform.
1. Eligibility
- You must be at least 13 years old to use Soundiary.
- If you are under 18 years of age, you confirm that you have permission from a parent or legal guardian to use the platform.
2. Accounts
- You must provide accurate and complete information when creating your account.
- You are responsible for maintaining the confidentiality of your login credentials and any activity under your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Subscriptions and Billing
- Soundiary is available under Free, Pro, and Family plans.
- Paid plans are billed monthly or annually in advance.
- All prices are in Australian Dollars (AUD) and include GST, unless stated otherwise.
- You must ensure that your payment method is valid and up to date.
4. Free Trials
- We may offer time-limited free trials of Pro features.
- You will not be billed during the trial period unless explicitly stated.
- After the trial ends, access will revert to the free plan unless you manually upgrade to a paid plan.
5. Cancellation and Refunds
- You may cancel your subscription at any time through your account settings.
- Access will continue until the end of the current billing period.
- We do not offer partial refunds for unused time unless required under Australian Consumer Law (ACL).
- Under ACL, you may be entitled to a refund or replacement if the service is faulty or fails to meet consumer guarantees.
6. Prohibited Conduct
You agree not to:
- Use Soundiary for any illegal, harmful, or abusive activities
- Resell, reproduce, or reverse-engineer any part of the platform
- Interfere with the platform's functionality or with other users
- Upload content that infringes on intellectual property or privacy rights of others
Violation of these rules may result in immediate account suspension or termination.
7. Intellectual Property
- All software, content, and assets within Soundiary are owned or licensed by Muso Play On PTY LTD.
- You are granted a limited, non-exclusive, non-transferable licence to use the platform in accordance with these Terms.
- You may not use, copy, or distribute any content unless explicitly permitted.
8. Limitation of Liability
- To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages.
- Our total liability is limited to the amount paid by you in the 12 months prior to the claim.
- Nothing in these Terms excludes your rights under Australian Consumer Law.
9. Termination
- We may suspend or terminate your access to Soundiary at any time if you violate these Terms.
- You may cancel or delete your account at any time via your settings.
- Upon termination, your right to use the platform immediately ends, and stored data may be deleted.
10. Changes to Terms
- We may update these Terms from time to time.
- Continued use of Soundiary after changes have been published means you accept the new terms.
- We recommend reviewing this page periodically.
11. Governing Law
- These Terms are governed by the laws of Victoria, Australia.
- Any disputes must be resolved in the courts of Victoria.
